Gizlilik Politikası ve KVKK Aydınlatma Metni

1. Kısaca Gizlilik

Kişisel verilerinizin korunması bizim için önemlidir. Bu metin, 6698 sayılı Kişisel Verilerin Korunması Kanunu'nun (“KVKK”) 10. maddesi ve Aydınlatma Yükümlülüğünün Yerine Getirilmesinde Uyulacak Usul ve Esaslar Hakkında Tebliğ uyarınca hazırlanmış aydınlatma metnidir. Bu web sitesini ziyaret ettiğinizde veya bizimle iletişime geçtiğinizde hangi kişisel verilerinizin, hangi amaçla ve hangi hukuki sebebe dayanarak işlendiğini açıklar.

Bu web sitesi çerez kullanmaz, analiz veya takip araçları kullanmaz ve üçüncü taraf içerik (ör. Google Fonts, Google Haritalar, sosyal medya eklentileri) yüklemez.

3. İşlenen Kişisel Veriler ve Toplama Yöntemi

Kişisel verileriniz, web sitemizdeki iletişim formu, e-posta, telefon ve sunucu kayıtları aracılığıyla, otomatik veya kısmen otomatik yollarla elektronik ortamda toplanır:

  • Kimlik: ad soyad
  • İletişim: e-posta adresi, telefon numarası (isteğe bağlı)
  • Müşteri işlem: seçtiğiniz paketler, mesajınızın içeriği, talep ve yazışma kayıtları
  • İşlem güvenliği: IP adresi, erişim tarihi ve saati, ziyaret edilen sayfa, yönlendiren sayfa, tarayıcı ve işletim sistemi bilgileri (sunucu kayıtları)
  • Finans (yalnızca müşterilerimiz için): fatura bilgileri (fatura adresi, vergi dairesi, VKN veya TCKN) ve ödeme kayıtları

4. İşleme Amaçları ve Hukuki Sebepler

  • Talebinize yanıt vermek, teklif hazırlamak ve sözleşme kurmak: KVKK md. 5/2-(c) – bir sözleşmenin kurulması veya ifasıyla doğrudan ilgili olması.
  • Hizmetlerin yürütülmesi, faturalandırma ve muhasebe: KVKK md. 5/2-(c) ve md. 5/2-(ç) – hukuki yükümlülüğün yerine getirilmesi (213 sayılı Vergi Usul Kanunu, 6102 sayılı Türk Ticaret Kanunu).
  • Web sitesinin güvenli ve hatasız çalışması (sunucu kayıtları): KVKK md. 5/2-(f) – temel hak ve özgürlüklerinize zarar vermemek kaydıyla meşru menfaatimiz.
  • Olası uyuşmazlıklarda hakların korunması: KVKK md. 5/2-(e) – bir hakkın tesisi, kullanılması veya korunması.

Ad soyad ve e-posta adresinizi paylaşmanız isteğe bağlıdır; ancak bu bilgiler olmadan talebinizi yanıtlayamayız. Telefon numarası yalnızca isterseniz sizi telefonla aramak için kullanılır. Kişisel verileriniz pazarlama amacıyla kullanılmaz ve onayınız olmadan size ticari elektronik ileti gönderilmez (6563 sayılı Kanun md. 6).

5. Kişisel Verilerin Aktarılması

Kişisel verileriniz satılmaz ve yukarıdaki amaçlar dışında üçüncü kişilerle paylaşılmaz. Verileriniz yalnızca şu alıcılara aktarılabilir:

  • Yurt içi: talep halinde yetkili kamu kurum ve kuruluşları (KVKK md. 8; md. 5/2-(ç)) ile hizmet aldığımız mali müşavir (faturalandırma ve vergi yükümlülükleri için).
  • Hosting sağlayıcısı: web sitesi ve iletişim formu, hizmet aldığımız hosting sağlayıcısının sunucularında çalışır.
  • E-posta hizmeti: iletişim formundan gönderilen talepler ve e-postalarınız, Google LLC tarafından sunulan Gmail hizmeti üzerindeki vyolninfo@gmail.com adresine iletilir. Google'ın sunucuları yurt dışında bulunabileceğinden, bu durum yurt dışına aktarım niteliği taşır.

Yurt dışına aktarımlar, KVKK'nın 9. maddesinde öngörülen şartlara ve güvencelere (ör. Kişisel Verileri Koruma Kurulu tarafından ilan edilen standart sözleşmeler) uygun olarak; bunların bulunmadığı arızi hallerde ise KVKK md. 9/6 kapsamında, sözleşmenin kurulması veya ifası ya da talebiniz üzerine alınacak sözleşme öncesi tedbirlerin uygulanması için zorunlu olduğu ölçüde gerçekleştirilir.

6. Saklama Süreleri

  • İletişim talepleri: talebiniz sonuçlandıktan sonra, bir sözleşme kurulmazsa en geç 6 ay içinde silinir.
  • Müşteri ve fatura kayıtları: 213 sayılı Vergi Usul Kanunu (md. 253) ve 6102 sayılı Türk Ticaret Kanunu (md. 82) uyarınca 5 ila 10 yıl saklanır.
  • Sunucu kayıtları: en geç 6 ay sonra silinir; bir güvenlik olayının incelenmesi için gerekli olanlar hariç.

Saklama süresi sona eren veriler, Kişisel Verilerin Silinmesi, Yok Edilmesi veya Anonim Hale Getirilmesi Hakkında Yönetmelik uyarınca silinir, yok edilir veya anonim hale getirilir.

7. Çerezler ve Dil Tercihinizin Kaydedilmesi

Bu web sitesi çerez kullanmaz. Sitenin dilini (Türkçe/İngilizce) değiştirdiğinizde, bir sonraki ziyaretinizde site seçtiğiniz dilde açılsın diye tercihiniz tarayıcınızın yerel deposuna (“localStorage”) kaydedilir. Yalnızca “tr” veya “en” değeri saklanır; bu bilgi cihazınızdan çıkmaz ve bize iletilmez.

Bu kayıt, açıkça talep ettiğiniz bir işlevin sunulması için zorunlu olduğundan, Kişisel Verileri Koruma Kurumu'nun Çerez Uygulamaları Hakkında Rehberi doğrultusunda açık rıza alınmaksızın yapılır. Kaydı istediğiniz zaman tarayıcı ayarlarınızdan silebilirsiniz.

Yazı tipleri ve SSL/TLS şifreleme

Kullanılan “Outfit” yazı tipi kendi sunucumuzda barındırılır; Google veya başka bir üçüncü tarafın sunucularına bağlantı kurulmaz. Site, güvenlik amacıyla SSL/TLS şifrelemesi kullanır; şifreli bağlantıyı adres çubuğundaki “https://” ifadesinden ve kilit simgesinden anlayabilirsiniz.

8. KVKK Madde 11 Kapsamındaki Haklarınız

Veri sorumlusuna başvurarak:

  • kişisel verilerinizin işlenip işlenmediğini öğrenme,
  • işlenmişse buna ilişkin bilgi talep etme,
  • işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,
  • yurt içinde veya yurt dışında aktarıldığı üçüncü kişileri bilme,
  • eksik veya yanlış işlenmişse düzeltilmesini isteme,
  • KVKK md. 7'de öngörülen şartlar çerçevesinde silinmesini veya yok edilmesini isteme,
  • düzeltme, silme veya yok etme işlemlerinin, verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
  • işlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle aleyhinize bir sonucun ortaya çıkmasına itiraz etme,
  • kanuna aykırı işleme sebebiyle zarara uğramanız halinde zararın giderilmesini talep etme

haklarına sahipsiniz.

9. Başvuru Yöntemi

Haklarınıza ilişkin taleplerinizi, Veri Sorumlusuna Başvuru Usul ve Esasları Hakkında Tebliğ uyarınca kayıtlı elektronik posta (KEP), güvenli elektronik imza veya mobil imza ile ya da sistemimizde kayıtlı e-posta adresinizden vyolninfo@gmail.com adresine iletebilirsiniz. Başvurunuzda ad soyad, T.C. kimlik numarası (yabancılar için uyruk ve pasaport/kimlik numarası), tebligata esas adres veya e-posta adresi ile talep konusunun yer alması gerekir.

Başvurunuz en geç 30 gün içinde ücretsiz olarak sonuçlandırılır; işlemin ayrıca bir maliyet gerektirmesi halinde Kurul tarafından belirlenen tarifedeki ücret alınabilir. Başvurunuzun reddedilmesi, verilen cevabı yetersiz bulmanız veya süresinde cevap verilmemesi halinde, cevabı öğrendiğiniz tarihten itibaren 30 gün ve her halde başvuru tarihinden itibaren 60 gün içinde Kişisel Verileri Koruma Kurulu'na şikâyette bulunabilirsiniz (KVKK md. 14).

10. Değişiklikler

Web sitesinin işlevleri veya yasal gereklilikler değiştiğinde bu metni güncelleriz. Her zaman burada yayımlanan güncel sürüm geçerlidir.

This is the privacy notice required by Article 10 of the Turkish Personal Data Protection Law No. 6698 (“KVKK”) and the Communiqué on the Procedures and Principles of the Obligation to Inform. It explains which personal data is processed when you visit this website or contact us, for what purpose and on which legal basis.

This website uses no cookies, no analytics or tracking tools and loads no third-party content (e.g. Google Fonts, Google Maps, social media plugins).

3. Personal data processed and how it is collected

Your personal data is collected electronically, by automated or partly automated means, through the contact form on this website, email, phone and server logs:

  • Identity: full name
  • Contact: email address, phone number (optional)
  • Customer transaction: selected packages, content of your message, enquiry and correspondence records
  • Transaction security: IP address, date and time of access, page requested, referrer, browser and operating system (server logs)
  • Finance (customers only): billing details (billing address, tax office, tax ID or Turkish ID number) and payment records

4. Purposes and legal grounds

  • Answering your enquiry, preparing an offer and concluding a contract: KVKK Art. 5(2)(c) – directly related to concluding or performing a contract.
  • Providing services, invoicing and accounting: KVKK Art. 5(2)(c) and Art. 5(2)(ç) – compliance with legal obligations (Tax Procedure Law No. 213, Turkish Commercial Code No. 6102).
  • Secure and error-free operation of the website (server logs): KVKK Art. 5(2)(f) – our legitimate interest, provided it does not harm your fundamental rights and freedoms.
  • Protecting rights in possible disputes: KVKK Art. 5(2)(e) – establishing, exercising or protecting a right.

Providing your name and email address is voluntary, but we cannot answer your enquiry without them. Your phone number is only used to call you if you wish. Your data is not used for marketing, and we do not send commercial electronic messages without your consent (Law No. 6563, Art. 6).

5. Transfers of personal data

Your personal data is never sold and is not shared with third parties beyond the purposes above. It may only be transferred to:

  • Within Türkiye: competent public authorities on request (KVKK Art. 8; Art. 5(2)(ç)) and our accountant (for invoicing and tax obligations).
  • Hosting provider: the website and contact form run on the servers of our hosting provider.
  • Email service: enquiries from the contact form and your emails are delivered to vyolninfo@gmail.com on the Gmail service provided by Google LLC. Because Google's servers may be located outside Türkiye, this constitutes a transfer abroad.

Transfers abroad take place in line with the conditions and safeguards of Article 9 KVKK (e.g. standard contracts announced by the Personal Data Protection Board) or, in occasional cases where these are not available, under Article 9(6) KVKK to the extent necessary to conclude or perform a contract or to take pre-contractual steps at your request.

6. Retention periods

  • Enquiries: deleted no later than 6 months after your enquiry has been handled if no contract is concluded.
  • Customer and invoice records: kept for 5 to 10 years under the Tax Procedure Law (Art. 253) and the Turkish Commercial Code (Art. 82).
  • Server logs: deleted after no more than 6 months unless needed to investigate a security incident.

Once the retention period ends, data is erased, destroyed or anonymised in accordance with the Regulation on the Erasure, Destruction or Anonymisation of Personal Data.

7. Cookies and your language choice

This website does not use cookies. When you switch the website's language (Turkish/English), your choice is saved in your browser's local storage (“localStorage”) so the site opens in that language on your next visit. Only the value “tr” or “en” is stored; it never leaves your device and is not sent to us.

Because this storage is strictly necessary to provide a function you have explicitly requested, it takes place without explicit consent, in line with the Personal Data Protection Authority's Guide on Cookie Practices. You can delete it at any time in your browser settings.

Fonts and SSL/TLS encryption

The “Outfit” font is hosted on our own server; no connection is made to Google or any other third party. The site uses SSL/TLS encryption for security; you can recognise an encrypted connection by “https://” and the padlock icon in your browser's address bar.

8. Your rights under Article 11 KVKK

By applying to the data controller, you have the right to:

  • learn whether your personal data is processed,
  • request information about the processing,
  • learn the purpose of processing and whether data is used accordingly,
  • know the third parties in Türkiye or abroad to whom data is transferred,
  • request correction of incomplete or inaccurate data,
  • request erasure or destruction under the conditions of Article 7 KVKK,
  • request that third parties to whom data was transferred be notified of such correction, erasure or destruction,
  • object to a result against you arising exclusively from automated analysis of your data,
  • claim compensation for damage caused by unlawful processing.

9. How to apply

Under the Communiqué on the Procedures and Principles of Applications to the Data Controller, you can submit requests via registered electronic mail (KEP), secure electronic signature or mobile signature, or from the email address registered with us to vyolninfo@gmail.com. Your application must include your full name, Turkish ID number (for foreigners: nationality and passport/ID number), a postal or email address for notifications and the subject of your request.

Your request will be answered free of charge within 30 days at the latest; if the action involves an additional cost, a fee may be charged according to the Board's tariff. If your request is rejected, you find the answer insufficient or we do not answer in time, you may lodge a complaint with the Personal Data Protection Board within 30 days of learning of the answer and in any case within 60 days of your application (Art. 14 KVKK).

10. Changes

We update this notice whenever the website's features or the legal requirements change. The current version published here always applies.
